1. Who you're contracting with
"MaximusDev", "we", "us", and "our" mean the trading name used by Tim Harfield, an individual based in Suffolk, United Kingdom. We are not a registered company. You are contracting directly with Tim Harfield (trading as MaximusDev).
"You" means the person or organisation that signs up to use MaximusDev. If you sign up on behalf of an organisation, you confirm you have authority to bind that organisation to these terms, and references to "you" mean both you personally and the organisation.
By creating an account or otherwise using the service, you agree to these terms. If you don't agree, don't use the service.
2. What MaximusDev provides
MaximusDev is a vibe-coding tool: you describe an app you want, the system designs and builds it using third-party AI models, and we host the result for you. Specifically:
- A web-based builder that turns prompts into deployed web apps
- Hosting on *.maximusdev.app subdomains (or your own domain on Pro and above)
- File storage for app assets via Cloudflare R2
- A Postgres database your apps can read and write to
- Routing of AI calls to a curated list of model providers via OpenRouter
- On Compliance and above: cryptographic receipts via TraceSeal for every AI call
There is also a separate locally-installed product, MaximusDev Local (£79 lifetime), governed by its own licence. These terms cover the cloud product only.
3. Your account
You need an account to use the service. We use Clerk for sign-up and authentication. You're responsible for keeping your credentials safe and for everything that happens under your account. Tell us at hello@maximusdev.cloud if you think your account has been compromised.
One person, one account. Don't share an account with others — use the team features when those ship, or each create your own.
You must be at least 16 years old to use the service.
4. Plans and billing
Current plans are listed at /pricing. The summary as of the effective date of these terms:

Prices are in pounds sterling (GBP), exclusive of VAT where it applies. Yearly plans are 20% cheaper than monthly.
Paid plans bill via Stripe. By subscribing you authorise Stripe to charge your payment method monthly (or yearly, if chosen) until you cancel. Stripe is the merchant of record for the subscription transaction. Their terms and privacy notice apply to the payment itself: stripe.com/legal.
If a payment fails we'll retry over a few days and email you. If we still can't take payment, the account drops back to the Free tier (your apps stay live; the paid features stop working) until the bill is settled.
We may change prices. If we do, current customers get at least 30 days' notice by email and the new price takes effect at their next renewal — never mid-cycle.
5. Credits and top-ups
One credit is roughly one back-and-forth with the AI. Your monthly allowance resets on your billing-cycle anniversary. Unused credits do not roll over to the next month.
If you run out, you can top up at the rates shown on /pricing. Top-up credits also expire at the end of your current billing cycle. We'll show you a notice in-app when you're about to run out — we don't auto-top-up by default.
If you bring your own key (see below), AI calls routed through your key don't deduct credits.
6. Bring-your-own-key (BYOK)
On Pro and above you can plug in your own OpenRouter API key. When you do, AI calls route through your key, billed by you to OpenRouter directly under their terms. (Direct Anthropic and OpenAI keys are not supported in v1; both providers are reachable via OpenRouter today.)
You're responsible for the spend on a BYOK key. We won't reimburse charges incurred against a BYOK key — including charges from a key that's been leaked, stolen, or used by someone other than you. Set spend limits in OpenRouter if that's a concern.
7. Free trial
Pro is offered with a 14-day free trial for new accounts. We take payment details at the start of the trial; nothing is charged until the trial ends. Cancel any time during the trial in Account → Billing and you won't be charged.
8. Cancellation and refunds
You can cancel a paid subscription at any time. Cancellation takes effect at the end of the current billing cycle — you keep paid features until then, and you're not charged again.
After cancellation, your apps and data stay live for 30 days. After 30 days everything is permanently deleted. Export anything you want to keep before then. We'll send a reminder email 7 days before deletion.
Refunds. Under UK consumer law, if you're a consumer (not a business) and you cancel within 14 days of starting a subscription, you can request a full refund — provided you haven't substantially used the service. After 14 days, or if you've used the service substantially, we don't issue refunds for partially-used periods. Email hello@maximusdev.cloud to request a refund.
9. Acceptable use
You agree not to use MaximusDev to:
- Build or host anything illegal under UK or EU law, or under the law of the country you're operating in
- Generate or distribute malware, phishing pages, or scams
- Generate child sexual abuse material, terrorist content, or content that incites violence against a person or group
- Spam, send unsolicited bulk email, or operate any kind of mass-message tool not in compliance with PECR/CAN-SPAM/equivalent
- Impersonate anyone, including by misusing brand names, faces, or voices without permission
- Bypass model providers' usage policies (Anthropic, OpenAI, etc.) — those policies pass through to you when you use their models via us
- Probe, scan, or attack our infrastructure or other users' apps
- Resell raw access to our AI routing as a "wrapper" SaaS — building products that use AI features is fine; reselling our infrastructure as your own is not
- Use the service in any way that would put us in breach of UK sanctions law, or make us subject to sanctions
The full Acceptable Use Policy has the long version. If you do any of the above we may suspend or terminate your account without notice.
10. Your content
You own your prompts, your code, your data, and the apps you build. Full stop. We don't claim any copyright over what you make.
You grant us a non-exclusive licence to host, transmit, copy, and display your content as needed to run the service for you (e.g. to send your prompt to an AI provider, to serve your app to your visitors, to back up the database). The licence is purely operational and ends when the content does.
You're responsible for making sure you have the right to upload, build with, or distribute your content. If you upload someone else's copyrighted material, that's on you, not us.
11. Our IP
The MaximusDev brand, the design of the site, the code that runs the platform, our documentation, and the TraceSeal receipt format are ours (or our licensors'). You don't get any rights to those just by using the service. Don't copy them, don't pass them off as your own.
12. AI output
You are the editor of your own apps. AI models make mistakes. They hallucinate facts. They generate code with bugs and security flaws. They produce outputs that don't quite do what you asked. This is unavoidable in 2026. You should review and test what an AI builds for you before relying on it for anything important.
We do not warrant that AI output will be accurate, secure, fit for purpose, or non-infringing. If your AI-generated app deletes a customer's data, leaks a secret, or runs up a bill against your BYOK key, that is your responsibility, not ours.
If your AI-generated content infringes someone's copyright or trade mark, that's between you and them — not us. We'll respond to lawful takedown notices but we don't pre-screen output.
Some model providers (notably Anthropic and OpenAI) offer indemnity for output infringement on their enterprise terms. Where those apply to your usage, you may benefit indirectly. We don't extend our own indemnity to cover AI-output IP claims.
13. Compliance receipts (Compliance tier and above)
On the Compliance and EU AI Act tiers, every AI call generates a TraceSeal cryptographic receipt. We make a best-faith effort to capture an accurate receipt for every call. Receipts are stored hot for 30 days and cold for 7 years.
If a receipt is missing or invalid for a call you made, that's a service defect — tell us and we'll investigate. We don't currently offer financial credit for missing receipts in v1; that's planned but not promised.
Receipts are evidence, not legal advice. If you're under a regulatory regime that requires specific evidence formats (financial services, healthcare, etc.) you should confirm with your own counsel that TraceSeal receipts meet the standard you need.
14. Availability and SLA
We aim to keep the service available 24/7. We don't promise uptime on the Free or Pro tiers — they're best-effort.
The Compliance tier targets 99.5% monthly uptime. The Compliance + EU AI Act tier targets 99.9%. If we miss the target in a given calendar month, we'll credit a pro-rata portion of that month's subscription on request, capped at one month's fee. Email hello@maximusdev.cloud within 30 days of the incident.
SLA targets exclude scheduled maintenance (we'll give 48h notice in-app and by email), force-majeure events, third-party outages outside our control (Cloudflare-wide, AWS-wide, OpenRouter outages), and your own misconfiguration.
15. Suspension and termination
We may suspend or terminate your account if:
- You break the acceptable-use policy
- You don't pay (after the dunning period in section 4)
- We're required to by law, court order, or sanctions
- You're putting our infrastructure or other users at risk
Where the breach is fixable and not severe, we'll email you first and give you a chance to fix it. Where it's severe (e.g. CSAM, active attacks), we suspend immediately.
You can terminate at any time by cancelling your subscription and deleting your account. After termination, the 30-day data-grace described in section 8 applies.
16. No warranty
Except for what UK law specifically requires us to provide, the service is provided "as is" and "as available". We don't warrant that it will be uninterrupted, error-free, secure, or fit for any particular purpose. We disclaim all implied warranties to the maximum extent the law allows.
This is not us trying to weasel out — it's an honest statement that one person operating a vibe-coding platform with third-party AI dependencies cannot promise more than they can actually deliver.
None of the above limits your statutory rights as a consumer where they can't lawfully be excluded.
17. Limitation of liability
Nothing in these terms limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) anything else that can't be limited under UK law.
Subject to that, our total liability to you under or in connection with these terms — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — is capped at the greater of (i) £100, or (ii) the total fees you've paid us in the 12 months immediately before the event giving rise to the claim.
We are not liable for: lost profits, lost revenue, lost data (except where required by law to recover it), loss of business opportunity, or any indirect or consequential loss, even if we'd been told the loss was a possibility.
18. Indemnity
You agree to indemnify us — meaning, defend us and pay any reasonable costs and damages — against any third-party claim arising from: (a) your content; (b) your apps and how they behave; (c) your use of the service in breach of these terms; or (d) your breach of any law in connection with the service.
19. Changes to these terms
We may update these terms. If a change materially affects your rights, we'll email everyone with an active account at least 30 days before it takes effect, and you can cancel during that window if you don't accept the change. Minor edits (typos, clarifying language) get a date update at the top of this page and nothing more.
20. Governing law and disputes
These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that if you're a consumer in another EU/EEA country, your local mandatory consumer-protection rules still apply and your local courts may also have jurisdiction.
